DMCA Policy

1. Overview

MERVELLA LLC ("Mervella") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our platform.

3. Filing a DMCA Takedown Notice

If you believe that content hosted on Mervella infringes your copyright, please provide the following information in writing:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing, with enough detail for us to locate it
  • Your contact information, including your address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

4. Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification including:

  • Your physical or electronic signature
  • Identification of the material that was removed and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located

5. Repeat Infringers

In accordance with the DMCA, Mervella will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We may also, at our sole discretion, limit access to the platform or terminate the account of any user who infringes any intellectual property right of others, whether or not there is any repeat infringement.

6. Good Faith

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Do not make false claims.

7. Response Time

We aim to process all valid DMCA notices within 5 business days. Upon receiving a valid notice, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the content
  • Provide information about the counter-notification process
